Rental Car Agency (Entity/Firm)

 

A rental car company shall not offer, sell or solicit the purchase of rental car insurance unless that entity is licensed and has otherwise complied with Chapter 50 of the Wyoming Insurance Code.

 

Authority: Wyo. Stat. § 26-50-101, et seq.

 

Term: Annual license expires March 31.

Company Appointment

A company/insurer appointment is required for an agency/firm.  The appointing insurer must be licensed in Wyoming and hold a casualty line of authority.  The form is available on the website and must be mailed to the Department.

 

By filing the appointment form, the insurer is certifying that:

·         The rental car agency is trustworthy and competent to act as a rental car agent;

·         The insurer has reviewed the endorsee training and education program and finds that it satisfies statutory requirements; and

·         The insurer appoints the agency to act as its rental car agent to offer, sell or solicit rental car insurance.

 

Designated Licensed Endorsee/Producer

A manager or direct supervisor of endorsees at each location must be licensed as an endorsee and is responsible for the supervision of all endorsees at that location.  See individual endorsee licensing page for detailed licensing information and forms.

Individual Endorsee Licensing

An employee or representative of a rental car agency may not offer, sell or solicit rental car insurance unless the individual has been licensed as an endorsee of the agency pursuant to Chapter 50 of the Wyoming Insurance Code.  See individual endorsee licensing page for detailed licensing information and forms.

 

Record Retention

Rental Car Agency must retain for six months from the date of each transaction, a record that enables it to identify the name of the endorsee involved in each rental transaction where a renter purchases rental car insurance.

 

Training/Continuing Education Program

 

·         Each agency shall provide training prior to allowing an endorsee to sell, solicit or offer rental car insurance.

·         The training program must be filed with the Department at least 30 days prior to use and must be approved by the commissioner.

·         Training can be conducted through electronic or video training and may be held at a location convenient for the individual endorsee.

·         The training material must contain:

o   Instruction about the kinds of insurance specified in Chapter 50 that are being offered for sale, and

o   Requirements and limitations imposed on car rental agents and endorsees by Chapter 50, specifically that the endorsee is prohibited from making any statement or conduct that would lead a consumer to believe that:

§  Purchase of rental car insurance is required in order to rent a car;

§  Renter does not have insurance policies in place that already provide the coverage being offered by the rental car company; and

§  Endorsee is qualified to evaluate the adequacy of the renter’s existing insurance coverage.

 

Annual Agency Certification Filing

Rental car company must submit an annual certification stating that:

·         No person other than an endorsee offers, sells or solicits rental car insurance on its behalf and

·         All endorsees have completed the endorsee training program.
